This article analyzes the framing of the Revolutionary Armed Forces in Razón Pública, a Colombian digital magazine, from July 2008 to July 2018. The article’s methodology combines Natural Language Processing and close reading. Results indicate that the magazine’s language primarily framed FARC as a protagonist of the peace process, and, secondarily, as an actor of Colombia’s armed conflict and drug trafficking. Shortly after Juan Manuel Santos’ first inauguration as Colombian president, some authors forecasted that the conditions were ripe for a (...) peace process with FARC. During the official negotiation, FARC was framed as enigmatic, and rational protagonist of a challenging peace process. Overall, the frames detected in this analysis are an echo of the UNDP Colombian Report that called for analytic journalism that improves the public’s understanding of the country’s complex armed conflict and proposes negotiated and military solutions. The compliance-based approach and the integrity approach have been the mainstream responses to corporate scandals. This paper proposes that, despite each approach comprising necessary elements, neither offers a comprehensive solution. Compliance and integrity, far from being mutually exclusive, reinforce each other. Working together, in a correct relationship, they build a harmonized system that yields positive synergies and which also advocates prudence. It enables the generation of a culture of compliance that tends to minimize the technical and ethical errors in decision (...) making. In order to explore an applied harmonized approach, we analyze the audit committee, a specific and broadly accepted regulatory instrument. Formed by non-executive members, regulation requires these members to be dedicated, qualified, and independent as a guarantee of efficiency. We show how the compound of those elements produces positive effects in a context of solid governance. We conclude that it is the strong relationship between efficiency and prudence, in the creation of a culture of compliance, which enables the minimization of errors. (shrink)

Research question/issue This paper aims to contribute to an improved theoretical and empirical understanding of the role that corporation has to play in anticorruption efforts. Research findings/insights Using cross-country data from three databases (Bribe Payers Index, Corruption Perceptions Index, and Doing Business) we found that pro-bribery Investment Climate conditions in host countries are not related to the payments of bribes by multinational companies when these corporations operate abroad. Theoretical/academic implications After describing the conceptual and policy framework that (...) surrounds the discussion on the role played by firms in anticorruption, we present the current debate regarding the effectiveness of international bribery control instruments, with the World Bank-GAC (2006-2008) report as a basis. Both literature and policy seem to be divided into two main, although not mutually exclusive, positions: one demands improvements in Investment Climate conditions from a joint public-private consensus led by international agencies; the other one supports the effectiveness of self-regulation by firms, independent of Investment Climate improvements. The study provides empirical support to the idea that a better Investment Climate is not enough for reducing corrup tion. Practitioner/policy implications This study offers insights to policy makers interested in promoting the involvement of corporations in the fight against corruption. (shrink)

The combined effect of coercion (public and private pressure), self-interest (competitive advantage) and conviction (intrinsically motivated or genuine) explain why environmental issues have become a key priority for companies. While research has explored coercion and competitive advantage, the role of conviction has received little attention. This paper aims to address this gap. Conviction, which has been correlated with institutional and individual drivers, offers more stable results and a potential multiplier effect as good examples are disseminated by imitation throughout an industry. (...) While the role of imitation has drawn increasing attention of business management studies, it has received scant attention in research on sustainability. This is the second gap this paper aims to address, contributing to the literature on sustainability in two ways: firstly, we will further explore the role of conviction in environmental sustainability; secondly, employing a compartmental model of epidemic propagation, used for other social phenomena, we model the role genuine examples by leaders can play within an industry and the dissemination of good behavior by imitation. Defining genuine conviction as the voluntary mitigation of the externalities of a firm's operations beyond that required by law or the market, substantiated in the responsible behavior of its leaders, our model discovers patterns that policymakers could use to create a “sustainability epidemic”. We suggest mathematical models of epidemics can be applied to sustainability, offering a fresh perspective on the phenomenon of imitation, allowing us to discover how some cultural and social habits can be used. On August Business Roundtable, the Business Roundtable redefined the purpose and social responsibility of the corporation. Yet, this statement must be followed by substantial changes in the business models of corporations for it to avoid becoming empty rhetoric. We believe that the figure of the independent director may be one of the catalysts needed for this change of paradigm for corporations. In spite of the positive correlation between Corporate Social Responsibility and board independence, the development of the independence of boards (...) during the last decade has not lead to the expected CSR results. Academics and regulators point to a weak definition and the non-standardized measurement of both independence and board independence as one possible explanation, and agree that a broader definition is needed. This paper aims to contribute to this debate. We develop a second-generation definition of independence based on a positive approximation to the concept by integrating an Aristotelian perspective of virtue ethics with the best practices of corporate governance. Thus, we define independence as a virtue guided by practical wisdom, that implies autonomy and autarky and which enables a person to act with integrity, fairness and truthfulness. In the context of corporate governance, independence is associated with an honest disposition to serve. Our proposal has political implications for supervisors that make decisions relating to the suitability of board members. (shrink)

The aim of this paper is to explore the ethical dimension of hawala, an ancient informal financial practice rooted in Islamic moral traditions. Widely used in countries with an Islamic background and their diasporas, hawala is considered an important vehicle for the financial and economic development of some less developed countries. Nevertheless, in Western countries, hawala is regarded with suspicion due its controversial ethical nature. Unlike other Islamic financial institutions, the controversial questions are not the legitimacy of profit sources or (...) the interest charged, but rather the lack of transparency that surrounds hawala transactions. Yet, the literature on hawala has neglected its ethical perspective. Our study delves into this dimension with a critical approach, using the Triple Font Theory, grounded on virtue ethics. We conclude that if hawala transactions are carried out with honesty, and fairness, this practice deserves a positive ethical appraisal. However, it is necessary to implement efficient regulatory measures to guarantee that the system is not abused by money launders and criminals. In practice, it becomes imperative to bring over a change in the regulatory approach to hawala toward a more ethically, culturally, and economically sensitive strategy. Thus, future research should focus on how “hyper-norms” or fundamental principles inherent to humanity, which are common to both “formal” and “informal,” “Western” and “non-Western” financial practices, could run the new AML/ctf regulation agenda. Fuera de preguntarse sobre el qué y el porqué de la comunicación, cuestiona el rol de la medición bibliográfica como criterio suficiente para determinar la calidad de la investigación y propone abrir un debate público con los desarrollos investigativos del campo. El debate toma aspectos epistémicos del campo de estudio y confronta la visión positivista que limita actualmente (...) las políticas gubernamentales sobre ciencia y tecnología. Finalmente se propone una visión más amplia de los problemas atinentes a la comunicación y se abren algunos interrogantes a propósito de la cienciometría como criterio de medición de calidad. The aim of this study was to analyze the psychometric properties of the Eating Disorder Inventory (EDI)-3 test to evaluate eating disorders in young Chilean population. Methods: The sample consisted of 1,091 Chilean adolescents and young people (i.e., 476 men and 615 women) between 15 and 28 years old, from the metropolitan region, and four regions from the coast and south-central zone of the country. The reliability and factorial structure of the instrument were analyzed, replicating the confirmatory factor analyses ofBrookings (...) et al. (2020), evaluating four additional models that included bifactor exploratory structural equation modeling (ESEM), bifactor, and two-bifactor. Results: A majority of the subscales presented alphas and omegas equal to or greater than 0.70, with the exception of asceticism (α = 0.543, ω = 0.552) and interpersonal alienation (α = 0.684, ω = 0.695) scales, which are consistent with the values of the Spanish and Mexican non-clinical samples. The best fit indices were obtained by the ESEM two-bifactor model, with twelve specific factors corresponding to the EDI-3 subscales and two general orthogonal factors (i.e., risk subscales and psychological subscales), consistently with the theoretical basis. This empirical study explores the characteristics and degree of implementation of so-called ethics hotlines in transnational companies (TNCs), which allow employees to present allegations of wrongdoing and ethical dilemmas, as well as to report concerns. Ethics hotlines have not received much attention in literature; therefore, this paper aims to fill that gap. Through the analysis of conduct/ethics codes and the compliance programs of the top 150 transnational companies ranked by the United Nations Conference on Trade and Development (UNCTAD) ( 2007 (...) ), we carry out a descriptive and taxonomic study of these companies’ ethics hotlines. We analyze: (1) the basic characteristics of the mechanism, (2) the degree of exigency and the provision of safeguards, (3) the matters reported and the systems for reporting, and (4) the relationships between hotlines and economic characteristics of the firm. Our study compares financial and nonfinancial TNCs as well as North American and European TNCs. Our results show that many firms (especially from North America) have established these procedures. We also find some disparities between European and North American ethics hotlines that suggest differences in the orientation of the procedures. (shrink)

The article aims to document the types of cyberviolence faced by 120 students of an urban high school in the cd. Toluca. Understood as an aggressive and intentional act online is about “sending and posting harmful or cruel texts or images over the Internet or other digital media”. Based on a mixed research design, the “online violence” self-report was applied, which allowed to identify trends and subsequently, from a narrative generating question, the experience stories with online violence were recovered.

El artista chileno José Miguel Blanco tuvo un rol protagónico en la escena cultural del país durante la segunda mitad del siglo XIX. Aparte de su labor escultórica, traducida en una cantidad importante de obras, una buena parte de su quehacer estuvo vinculado con la escritura de arte, lo que se materializó, principalmente, en el periódico El Taller Ilustrado, el primer medio informativo en el país dedicado exclusivamente a temas de arte, que este escultor creó y dirigió por casi cinco (...) años. Desde esa tribuna Blanco promovió información, debates e iniciativas que favorecieron el desarrollo cultural del país. Este escultor es, sin lugar a dudas, el autor más prolífico en la escritura artística chilena de su tiempo. The Chilean artist José Miguel Blanco had a protagonic role in the culture scene in the country during the second half of the 19th century. Besides his works of sculpture, reflected in an important quantity of pieces of art, a great part of his work was related to the Artistic Writing, which was materialized, mainly in the newspapers called El Taller Ilustrado, the first informative media in the country dedicated exclusively to the topics of Art, that this sculptor created and managed for almost five years. From this tribune, Blanco promoted information, debates and initiatives that contributed to the development of culture in Chile. The sculptor is, without any doubt, the most prolific author in Chilean Artistic Writing in his time. (shrink)

El presente estudio aborda el nacimiento como problema filosófico desde una perspectiva intersubjetiva y corporeizada derivada del análisis del Cuerpo y el Otro presente en la Fenomenología de la Percepción de Merleau-Ponty. A partir de lo anterior, se discuten las limitaciones que tendría la coexistencia (Mitdasein) de Heidegger y la Otredad de Lévinas enmarcada en la relación del rostro en su intento de aproximarse a una filosofía del nacimiento desde una perspectiva de mundo compartido (madre-padre-hijo). Además, se plantea la necesidad (...) de incorporar al problema filosófico sobre el nacimiento tres etapas: embarazo-nacimiento-puerperio, ya que estas son fundamentales para ilustrar de manera profunda la dimensión relacional y corporeizada de este proceso que exhibe temporalidad e historicidad. In the past 50 years nurse scheduling has received considerable attention in the research community. There are two cases regarding the nurse scheduling problem : the static and dynamic. Dynamic NSP, is often called nurse rerostering problem, which presents reconstruction or modification of the predetermined roster for the current scheduling horizon. The aim of this paper is to present new hybrid strategy for nurse NRRP problem. The proposed methodology is based on efficient cooperation between fuzzy logic, ordered weighted averaging and (...) variable neighbourhood descent search. IntroductionIdeas of reference are frequent in psychopathology, mainly in psychotic disorders. The frequency of IR and preoccupation about them are related to the psychotic dimension, and to a lesser extent, to negative or emotional disorganized dimensions. Aberrant salience, has been proposed as an indicator of the onset of psychosis, particularly of schizophrenia. This study analyzed the mediating role of AS, disorganized symptoms and preoccupation about IR in the relationship between IR and the psychotic dimension.MethodThe sample consisted of 330 participants, 62.4% (...) of whom were women aged 18–79. The Referential Thinking Scale, the Aberrant Salience Inventory, and the Brief Psychiatric Rating Scale were administered.ResultsEvidence of a partial mediation model showed that the relationships between IR and the psychotic dimension were mediated jointly by AS and the disorganized dimension, and preoccupation about IR no longer had a role. This relationship was significantly influenced by participant age. The variables in the model explained 54.16% of the variance.ConclusionThe model proposed enabled a set of vulnerabilities to be predicted that could lead to a high-risk general pathological state and proneness to psychosis in particular. These findings are discussed with regard to early detection and prevention of psychosis. (shrink)

The Patients’ Rights and Duties Act, promulgated in Chile in 2012, has made the informed consent process a critical step to respect the patient’s autonomy. It is then relevant to test health workers’ knowledge of the subject, especially in the surgery department. We carried out a quantitative study on 90 specialists from the surgery department in a public tertiary hospital, to whom a questionnaire was administered to test their knowledge of informed consent. The family of discounted Shapley values is analyzed for cooperative games in coalitional form. We consider the bargaining protocol of the alternating random proposer introduced in Hart and Mas-Colell. We demonstrate that the discounted Shapley values arise as the expected payoffs associated with the bargaining equilibria when a time discount factor is considered. In a second model, we replace the time cost with the probability that the game ends without agreements. An important approach to understand how the brain gives rise to consciousness is to probe the depth of unconscious processing, thus to define the key features that cause conscious awareness. Here, we investigate the possibility for subliminal stimuli to shape the context for unconscious processing. Context effects have generally been assumed to require consciousness. In the present experiment, unconscious context processing was investigated by looking at the impact of the context on the response activation elicited by a subliminal prime. We (...) compared the effects of the same subliminal prime on target processing when the prime was embedded in different unconscious contexts. Results showed that the same prime can evoke opposite responses depending on the unconscious context in which it is presented. We propose to discuss about the possession and expression of a capacity that empowers individuals to act as citizens. First, elements of Aristotelian politics are presented as arguments for civility as a capacity inherent in the social nature of human beings. Then, according a contractualist interpretations, the individual becomes a citizen to the extent that he forms an agreement with the other members of society. A first finding refers to the fact that with contractualism, the individual has lost the inherence (...) of his civic action and must define himself as a citizen if he meets the extrinsically given requirements Likewise, it is indicated that the expression of civility has been interfered with by an idea of individual freedom understood in negative terms. However, before returning to Aristotelian perspective, it is necessary to redefine the idea of freedom that guides civic interaction, advocating for a social and intrinsically motivated citizenship. Proponemos discutir sobre la posesión y expresión de una capacidad que faculta a los individuos para actuar como ciudadanos. Primero, se exponen aspectos de la política aristotélica como argumentos en favor de la civilidad como una capacidad inherente a la naturaleza social de los seres humanos. Luego, desde una interpretación contractualista, el individuo se convierte en ciudadano en la medida en que establece acuerdos con los demás miembros de la sociedad. Así, una primera constatación se refiere a que, con el contractualismo, el individuo ha perdido la inherencia de su acción cívica y es definido como ciudadano en la medida en que cumple requisitos dados extrínsecamente. Asimismo, se indica que la expresión de civilidad se ha visto interferida por una idea de libertad individual entendida en términos negativos. Sin embargo, antes de retomar una perspectiva aristotélica, es necesario redefinir la idea de libertad que guía la interacción cívica, abogando por una ciudadanía social e intrínsecamente motivada. El libro se divide en tres partes que comprenden desde la filosofía alejandrina hasta el periodo ético y religioso de los griegos, con lo que se completa el cuadro de la filosofía helenística.

In discussions of standards of proof, a familiar perspective often emerges. According to what we call specificationism, standards of proof are legal rules that specify the quantum of evidence required to determine that a litigant’s claim has been proven. In so doing, they allocate the risk of error among litigants (and potential litigants), minimizing the risk of certain types of error. Specificationism is meant as a description of the way the rules actually function. We argue, however, that its claims are (...) either mistaken or at a minimum deeply misleading, especially when it comes to standard of proof rules (SPRs) that contain indeterminate formulas, as is typical. As against specificationism, we argue that SPRs are best understood as rules that confer competence to decide whether a given standard has been met—according to whatever vague or inchoate interpretation (if any) of the rule in question triers of fact implicitly or explicitly employ. En este trabajo proponemos un análisis de los esquemas de argumento por signo que fueron identificados en las etiquetas interpretativas de las exposiciones permanentes de los museos de la región de la Araucanía. Se analizan cualitativa y críticamente tres casos de los veintiún esquemas por signo identificados. Las herramientas teóricas esgrimidas proceden de la pragma-dialéctica y la lógica informal. Nuestro objetivo es caracterizar los esquemas por signo identificados en las etiquetas de las exhibiciones de los museos de la Araucanía, en (...) la búsqueda de orientar su manejo en el diseño de exhibiciones museísticas significativas. Para ello, hemos desarrollado una matriz metodológica que adopta el levantamiento de una estructura argumental. Así, fue posible identificar los puntos de vista como las razones que lo justifican, además de identificar los esquemas argumentativos, a los cuales se les ha aplicado sus respectivas preguntas críticas. El análisis nos permitió concluir que en el empleo del esquema por signo siempre es necesario apoyarse en el entorno cercano donde se maneja el argumento, esto incluye la noción de lugar o de territorio en sus distintos niveles de significación. Asimismo, se ha comprobado como fundamental la incorporación de la tercera pregunta crítica al esquema por signo, la cual hace referencia al contexto donde se presenta el argumento. Por último, se ha detectado que los esquemas considerados complejos también realizan una referencia al lugar, pero con la utilización y combinación de variadas figuras retóricas, como la resignificación o sustitución. The main claim of this paper is the following: In a typical rational legal system, legal adjudication is necessarily discretional. Discretion is the result of what I call ‘systemic indeterminacy’. Systemic indeterminacy is the thesis that claims that typical rational legal systems that have an interpretative code with more than one interpretative directive and the non-redundancy clause are necessarily indeterminate. Since typical rational legal systems do not have redundant rules a plurality of interpretative directives will necessarily yield a plurality of (...) interpretative results. Due to the non-liquet rule judges are obligated to choose among the different interpretative results provided by the interpretative code. In other words, by building a thesis on legal indeterminacy as the consequence of having a plurality of interpretative directives that necessarily yield different results, I proceed to provide an account of discretion as a necessary feature of legal adjudication. La longue cinquieme partie, structuree thematiquement plutot que chronologiquement, est reservee non seulement a la reprise synthetique, mais aussi a la confrontation critique. Elle examine les differents aspects de la conception fichteenne du christianisme, notamment sa position a l'egard du Nouveau Testament, de la dogmatique, de la morale et de la mystique chretiennes.
